Terms and Conditions

1. Scope

These Terms and Conditions apply to all business relationships between Elba Technologies GmbH (hereinafter "Chat Safe") and our customers regarding the use of the Chat Safe platform and related services.

2. Service Description

Chat Safe offers a secure, encrypted AI chat platform that connects to various AI models and providers while maintaining user anonymity through homomorphic encryption. The exact services are outlined in the respective product descriptions and agreements.

3. Usage Rights

Customers receive a non-exclusive, non-transferable right to use the Chat Safe platform within the agreed scope. Usage is limited to the duration of the contract.

4. Pricing and Payment Terms

Prices are determined by the selected plan. Payments are due within 14 days of invoicing. All prices are subject to applicable VAT. For the standard Professional Subscription, the monthly fee is 29€ or 29$.

5. Data Protection and Security

We process data in accordance with our privacy policy and applicable data protection laws. Data security is ensured through our homomorphic encryption technology, which prevents AI providers from accessing the original content of user communications.

6. Liability

We are liable for intentional misconduct and gross negligence. Liability for slight negligence is limited to contract-typical, foreseeable damages.

7. Contract Duration and Termination

The minimum contract duration depends on the selected plan. The notice period is 30 days before the end of the contract period.

8. Use of Third-Party AI Services

Chat Safe provides access to various third-party AI services (like OpenAI, xAI, Google, etc.). While we ensure your anonymity and data encryption when using these services, we are not responsible for their availability, accuracy, or any changes to their functionality.

9. Intellectual Property

All intellectual property rights to the Chat Safe platform, including the encryption technology, remain with Elba Technologies GmbH. Customers may not reverse engineer, decompile, or attempt to extract the source code of our service.

10. Final Provisions

German law applies. Place of jurisdiction is Teltow, Germany. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
